James W. Boice, 39, of Harpers Ferry, W.VA. was
struck and killed in Leesburg Saturday at about 6:30 AM while he was stopped at an intersection. According to police, the Suzuki motorcycle he was riding was struck by a Jeep Cherokee SUV driven by Brian H. Beck, who was cited for reckless driving. How or why this tragic accident happened is not yet known, and local police are looking for witnesses. However, based upon our experience, it is important that Mr. Boice's family retain an investigator immediately to look for potential witnesses, interview possible witnesses in the vicinity, and examine the scene for any physical evidence that might be recoverable. This is because in our experience, because of the "contributory negligence doctrine" in Virginia, insurance companies will use any excuse to deny liability, particularly where the injured party is on a motorcycle.
